HaxSolutions LLC and its affiliates (“we,” “our,” or “us”) provide software services through the website haxwallet.com and its associated mobile applications (collectively, the “Services” or “Hax Wallet”). Before using our Services, please carefully read these Terms of Service (the “Terms”), along with any additional policies or notices available on our website or mobile applications.

Acceptance of Terms

By accessing or using any part of the Services, you acknowledge that (i) you have read and understood these Terms; (ii) you agree to be bound by these Terms; and (iii) you have the legal capacity to enter into these Terms. If you do not accept these Terms or any future modifications, you must discontinue your use of our Services.

WE DO NOT PROVIDE INVESTMENT OR FINANCIAL ADVICE. WE ONLY OFFER THE HAX WALLET APP AND DO NOT MAKE RECOMMENDATIONS OR GIVE ADVICE ABOUT DIGITAL ASSET TRANSACTIONS. YOU ALONE ARE RESPONSIBLE FOR ANY DECISIONS REGARDING DIGITAL ASSET TRANSACTIONS.

Eligibility

To use Hax Wallet, you must meet the following requirements:

  1. Age and Legal Capacity: You must be at least eighteen (18) years old and possess the legal capacity to enter into these Terms.
  2. Business or Organizational Use: If you are accessing our Services on behalf of a company, organization, or other legal entity, you represent and warrant that the entity is properly formed, validly existing under the laws of its jurisdiction, and that you are duly authorized to act on its behalf.
  3. Restricted Locations: You must not be located in, or be a resident, national, or entity under the jurisdiction of, any country or region subject to comprehensive sanctions imposed by the United States or other applicable authorities. This includes, without limitation, Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine.
  4. Prohibited Persons: You must not be listed on any sanctions, restricted, or prohibited persons lists maintained by the U.S. government (including OFAC Specially Designated Nationals and Blocked Persons List, Foreign Sanctions Evaders List, or BIS Entity List), the United Nations, the European Union or its member states, the United Kingdom, or any other relevant sanctions authority.
  5. Legal Compliance: Your use of Hax Wallet must comply with all applicable laws in your jurisdiction. You are prohibited from using our Services in any state, country, territory, or region where doing so would be unlawful. You represent and warrant that any funds you use with Hax Wallet are obtained legally and belong to you.
  6. Company Discretion: Hax Wallet reserves the right, at its sole discretion, to deny access to any individual or entity, for any reason permitted by law. We may also update or change these eligibility criteria at any time to comply with applicable laws, regulations, and internal policies.

Financial Conduct Authority (FCA) Risk Warning for United Kingdom Users

Important Notice: If you are accessing Hax Wallet from the UK, please read carefully:

  • High-Risk, Unregulated Investment: Cryptocurrencies and digital assets are unregulated in the UK. They are not protected by the Financial Services Compensation Scheme (FSCS) or the Financial Ombudsman Service (FOS).
  • Volatility and Loss: The value of digital assets can fluctuate significantly. Don’t invest unless you’re prepared to lose all the money you invest. Only invest what you can afford to lose.
  • No Advice or Promotion: Hax Wallet does not provide investment advice and does not promote, recommend, or endorse any specific token or crypto project. All investment decisions are your responsibility.
  • Liquidity and Complexity Risks: You may not always be able to sell or convert assets at your desired price or time. Digital assets can be complex; thorough research is strongly advised.
  • Exposure Recommendation: FCA guidance suggests limiting exposure to high-risk investments, such as cryptoassets, to no more than 10% of your portfolio.
  • Acknowledgement: By using Hax Wallet in the UK, you confirm that you understand and accept these risks. You must actively acknowledge this warning before proceeding with any transactions.

Services

Hax Wallet is a non-custodial digital wallet designed for the management of digital assets such as cryptocurrencies, virtual commodities, and NFTs (“Digital Assets”). As a non-custodial wallet, you retain full control over your Digital Assets and private keys. You are solely responsible for authorizing transactions and managing your wallet, and Hax Wallet does not have access to your funds. Consequently, all risks associated with your Digital Assets—including loss, theft, or unauthorized access—remain entirely your responsibility.

Through Hax Wallet, you can:

  1. Create Wallets: Generate wallet addresses and corresponding private keys, enabling the sending and receiving of a wide range of digital assets.
  2. Access DApps and DEXs: Explore and use third-party decentralized applications (“DApps”) and decentralized exchanges (“DEXs”) directly via the Hax Wallet in-app browser.
  3. Swap and Trade Assets: Conduct digital asset swaps and trades using DApp features provided by independent third-party service providers.
  4. Staking Services: Participate in staking or other Proof-of-Stake networks through third-party staking platforms integrated with Hax Wallet.
  5. Market Data: View digital asset prices and market information supplied by independent third-party sources.
  6. Broadcast Transactions: Submit transaction data to supported blockchain networks without the need to download or operate the corresponding blockchain software on your device.

Wallet Address, Private Key, and Backup Responsibilities

Hax Wallet allows you to generate and manage wallet addresses, private keys, and associated encrypted backups on compatible devices. Your wallet address is cryptographically linked to a private key, and together they authorize the transfer of Digital Assets into and out of your wallet. You are solely responsible for securing and maintaining the confidentiality of your private key and any mnemonic phrase (“Secret Phrase”) connected to your wallet.

It is essential that you take all necessary precautions to safeguard your wallet address, Secret Phrase, private key, and any backup information. This includes securely storing any passwords, backup phrases, or keys. Failure to do so may result in permanent loss of access to your Digital Assets. Hax Wallet does not store, retain, or have access to your wallet password, private key (encrypted or unencrypted), or Secret Phrase, and we cannot recover or reset this information on your behalf.

If you do not maintain a secure backup of your private key and wallet address pair, any Digital Assets tied to that wallet will become inaccessible. Hax Wallet expressly disclaims any responsibility or liability for losses arising from your inability to access your wallet, including but not limited to negligence in securing your wallet address, Secret Phrase, or private key.

By using Hax Wallet, you acknowledge that protecting your Digital Assets is entirely your responsibility. You agree that you are solely accountable for any actions taken within the wallet and accept the inherent risks involved in managing and safeguarding digital assets.

 Decentralized Exchange (DEX) Usage

When using decentralized exchanges (“DEX”) through Hax Wallet, including features for trading or swapping digital assets, you agree to the following:

  1. Third-Party Swap Providers: DEX services are provided by independent third-party swap providers. Hax Wallet does not operate, control, or endorse any DEX or swap provider, and is not responsible for your transactions or outcomes.
  2. Restricted Territories: Certain third-party swap providers enforce restrictions for users located in or associated with prohibited territories. Hax Wallet, via its DEX partners, does not interact with digital wallets located in, established in, or owned by residents of Cuba, Bolivia, Bangladesh, Crimea and Sevastopol, the so-called Donetsk People’s Republic, Iran, the so-called Luhansk People’s Republic, Democratic People’s Republic of Korea (North Korea), Somalia, Sudan, Syria, or any other jurisdiction included on applicable sanction lists.
  3. Limits and Rules: Any limits on trade volume, swap amounts, or other restrictions are set by the third-party swap providers and the smart contracts they use. Hax Wallet does not control these rules and is not liable for enforcing them.
  4. Finality of Transactions: All DEX transactions are irreversible. You are fully responsible for any mistakes, including sending assets to wrong addresses or encountering technical issues with blockchain nodes.
  5. Fees: Transactions through DEX may incur fees set by third-party swap providers. Hax Wallet does not control these fees, and any information displayed in the app is for reference only. You are responsible for verifying fees before using DEX services.
  6. Future Charges: Hax Wallet reserves the right to introduce fees for DEX services in the future. Any updates will apply only to new transactions, and users will be notified through reasonable means.

By using DEX services via Hax Wallet, you acknowledge that you assume all risks, responsibilities, and potential costs, and that the DEX providers may limit access in restricted territories.

Decentralized Application (DApp) Usage

When accessing decentralized applications (“DApps”) via Hax Wallet’s in-app browser, you must understand and accept the following:

  1. Third-Party Control: DApps are independently developed and maintained. Hax Wallet does not control, endorse, or guarantee the functionality, security, or reliability of any DApp.
  2. User Responsibility: All interactions with DApps, including submitting transactions or sharing data, are your responsibility. Hax Wallet is not liable for losses, errors, or issues arising from your use of any DApp.
  3. Irreversible Actions: Any actions taken within DApps, such as token transfers or staking operations, are final and cannot be reversed. You are responsible for ensuring accuracy and completeness of any information provided to the DApp.
  4. Fees and Costs: DApps may charge fees or require payments through their smart contracts. Hax Wallet does not control these fees, and any displayed information about them is for reference only. You should verify all fees with the DApp provider.

By using DApps through Hax Wallet, you acknowledge that Hax Wallet serves only as a gateway and that all risks, responsibilities, and obligations lie with you as the user.

Digital Asset Transactions

All transactions involving Digital Assets through Hax Wallet are processed, recorded, and validated on the respective public blockchain of the asset. These blockchain networks are decentralized, peer-to-peer systems maintained by independent third parties, and are not owned, controlled, or operated by Hax Wallet.

By using Hax Wallet, you acknowledge and agree to the following:

  1. No Transaction Reversal: Hax Wallet cannot cancel, modify, or reverse any transaction submitted by you.
  2. Blockchain Confirmation: Blockchain networks may delay, fail, or otherwise not complete the transactions you submit. Hax Wallet has no control over these confirmations.
  3. Non-Custodial Nature: Hax Wallet does not store, transmit, or receive Digital Assets. All transfers, balances, and related actions occur entirely within the blockchain protocol.
  4. Title and Rights: Any transfer of Digital Assets is executed on the relevant blockchain network and not through any network operated by Hax Wallet. Consequently, Hax Wallet does not guarantee the transfer of ownership, title, or rights of any Digital Asset.

By conducting transactions through Hax Wallet, you accept all risks inherent to blockchain operations, including network delays, technical failures, and the volatility of Digital Asset markets.

Use of Staking Services

When you participate in staking through Hax Wallet, you do so via a third-party provider that stakes certain Digital Assets (“Staked Digital Assets”) to help validate transactions on the corresponding blockchain network. Successful validations may result in network-issued rewards (“Staking Rewards”).

By using the Staking Service, you acknowledge and agree to the following:

  1. Independent Providers: Hax Wallet does not control or manage any staking provider. We disclaim all liability for any issues, losses, or failures related to staking, including loss of Staked Digital Assets, failure to earn Staking Rewards, or fees incurred.
  2. No Guarantee of Continuity: Staking operations may be interrupted or delayed due to factors beyond Hax Wallet’s control, such as updates to codebases, blockchain protocol changes, network congestion, or actions by third-party providers.
  3. Eligibility and Availability: Hax Wallet cannot ensure that any particular Digital Asset can be staked. Staking availability is determined by the rules of the blockchain network and the terms set by the third-party staking provider.
  4. Rewards Control: Hax Wallet has no control over Staking Rewards, including the timing, frequency, or amount. These are determined solely by the relevant blockchain network.
  5. No Financial Advice: Hax Wallet does not provide investment advice, predictions, or recommendations regarding any Digital Asset or staking opportunity. All decisions to stake are made at your own discretion.
  6. Non-Custodial Nature: Hax Wallet does not take custody of your staked assets or rewards and has no control over the underlying Proof-of-Stake network where your staking occurs.
  7. Reward Risks: Staking rewards are not guaranteed. You may experience loss of rewards due to network penalties (“slashing”), incorrect wallet addresses, or other blockchain-related issues outside Hax Wallet’s control.
  8. Service “As-Is”: Hax Wallet provides staking services on an “as-is” basis. We do not guarantee uninterrupted or error-free operation and are not responsible for failures caused by third parties or unauthorized access.
  9. User Responsibility: Before staking, you should conduct thorough research and evaluate your risk tolerance and financial objectives. By using the Staking Service, you accept full responsibility for your decisions and the associated risks.
  10. Amendments: Hax Wallet reserves the right to modify this section at any time without prior notice. It is your responsibility to review this section periodically. Continued use of the Staking Service constitutes acceptance of any changes.

Privacy Policy

For information on how we collect, use, and disclose user information, please review our Privacy Policy. By using the Services, you acknowledge that your use is governed by our Privacy Policy, and you consent to our collection, use, and disclosure of your information (including any personal data you provide) in accordance with the policy.

Changes to the Terms

We may update or change these Terms at any time at our discretion. If changes are made, we will notify you by posting the revised Terms on our website, mobile app, or through other communication methods. The revised Terms will become effective immediately unless stated otherwise. Please check our website regularly for updates. If you continue to use Hax Wallet after any modifications, you agree to the revised Terms. If you do not agree, discontinue your use of our Services. Our Services may be modified or discontinued at any time without notice and at our discretion.

Third-Party Services and Content

Hax Wallet may provide access to services and content offered by independent third parties, including but not limited to crypto-to-crypto swaps, staking services, cryptocurrency purchases and sales, fiat balance displays, cryptocurrency price data, decentralized finance (DeFi) applications, NFT viewing, minting, buying, and selling (“Third-Party Services”). Any content, products, or services provided by these partners are considered third-party content (“Third-Party Content”).

Your engagement with Third-Party Services and Content is entirely voluntary and done at your own risk. Interactions with these services may be subject to additional terms, conditions, fees, disclaimers, and privacy policies imposed by the third-party provider. It is your responsibility to review and understand these terms before using any Third-Party Services.

Hax Wallet does not control, endorse, or guarantee the accuracy, reliability, or success of any Third-Party Services. Any disputes, complaints, or claims arising from your use of these services should be directed to the respective third-party provider. Your use of Third-Party Services does not relieve you of responsibility for any actions taken within your wallet, including actions by authorized third parties.

Hax Wallet may provide optional push notifications from third parties. Such notifications are not enabled automatically and require your explicit consent. We do not guarantee the accuracy or validity of any information included in these notifications.

Hax Wallet reserves the right to modify, suspend, or discontinue access to any Third-Party Services at our discretion. Any reference to a third-party product or service does not constitute an endorsement or approval by Hax Wallet.

Payment and Transaction Fees

Fees for Hax Wallet services or any related operations are primarily determined by third-party providers. These may include, but are not limited to, account management fees, transaction fees, withdrawal fees, network (gas) fees, or fees for specific partner services. Hax Wallet does not control or influence the creation, adjustment, or application of these fees.

Third-party providers may modify their fees independently. Hax Wallet may receive a portion of revenue from certain third-party fees; however, this does not grant us authority or control over fee structures. Updates to fee information will be posted on our website and/or within the Hax Wallet app, and your continued use constitutes acceptance of any changes. Users are responsible for staying informed about applicable fees.

Transaction Fees: Transactions involving Digital Assets may incur blockchain or network fees (e.g., mining fees or gas fees) mandated by the relevant blockchain. It is your responsibility to ensure sufficient balance or network resources to complete a transaction. Hax Wallet does not control these fees and is not liable for failed transactions or financial losses resulting from insufficient fees, incorrect fee entries, or insufficient wallet funds.

Due to the non-custodial nature of Hax Wallet, we do not access, manage, or store your transactions or private keys. All transactions occur solely on the blockchain or through third-party services you choose to engage with.

License

Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-sublicensable, and non-transferable license to use Hax Wallet strictly for personal or internal business purposes. Except as expressly permitted, you must not:

(a) copy, modify, or create derivative works of any part of Hax Wallet;

(b) rent, sell, distribute, sublicense, or otherwise transfer access to Hax Wallet;

(c) use Hax Wallet for or on behalf of any third party;

(d) integrate Hax Wallet into another product or service without prior written approval;

(e) bypass, disable, or tamper with any usage restrictions;

(f) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying structure of Hax Wallet, except as permitted by law;

(g) remove or obscure proprietary notices; or

(h) use Hax Wallet for competitive purposes.

Acceptable Use

You agree to use Hax Wallet only in compliance with applicable laws and regulations. You must not use our Services for illegal or prohibited activities, including but not limited to fraud, money laundering, terrorist financing, illegal gambling, or other unlawful conduct.

In particular, you agree not to:

(i) encourage or assist others to engage in prohibited activities;

(ii) impersonate others, or attempt to gain unauthorized access to wallets or accounts;

(iii) upload or distribute malware, viruses, or harmful code;

(iv) overload, disrupt, or interfere with our systems or third-party providers;

(v) attempt to bypass security measures or gain unauthorized access to networks connected to our Services;

(vi) violate or infringe the rights of others, including intellectual property, privacy, or publicity rights.

We reserve the right, at our sole discretion, to suspend or terminate access to Hax Wallet at any time without notice if these Terms are violated.

You understand that use of Hax Wallet may expose you to third-party content that could be offensive or objectionable, and you agree that we are not responsible for any such content or resulting damages.
